Competition Terms & Conditions

To celebrate over 40 years in Australia, Volvo Buses are kicking-off 2013 with the VOLVO LIFE Competition and all you have to do is upload a photo! To thank you for sharing your Volvo Life photos, there are a number of prizes on offer. Our Judging Panel will be awarding prizes to their favourite images and also prizes to each ‘Photo of the Month’, plus there will also be a ‘People’s Choice Award’. Participation

1. 1. This competition ("Competition") is conducted by Volvo Buses ("Promoter"), ABN 27 000 761 259 of 120 Hume highway, Chullora NSW 2190, 02 8713 8266).
2. Entry into the Competition constitutes acceptance of these Terms and Conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. Eligible Entrants (“Eligible Entrant”): The Competition is open to residents of Australia aged 18 years or older as at the time of entry. Employees of the Promoter and their immediate families (including de-facto spouse, parent, child or sibling, whether full, half, step or by adoption) or any of its related corporations or any of their agencies associated with the Competition are ineligible to enter.
4. Notwithstanding any other provision of these conditions, a person "Person" is not entitled to enter this Competition if: (i) the Promoter has formed the opinion that the Person has breached the conditions of entry of a previous contest run by the Promoter; and (ii) the Person has been given written or emailed notice by the Promoter stating that, as a result of such opinion of the Promoter, the Person is prohibited from entering competitions conducted by the Promoter (and the prohibition stated in that notice has not been lifted by a subsequent notice to the Person from the Promoter).
5. Competition entry opens at 09:00 hrs on Wednesday February 13, 2013 and closes at 17:00 hrs on Sunday June 30, 2013 ("Entry Period"). All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.

Conditions of Entry

1. Eligible Entrants may enter the Competition multiple times and they may submit multiple images per entry (maximum of five images per entry). Entries can only be submitted via the Internet.
2. The action of uploading an image as a Competition entry is deemed as your confirmation that you own the rights to that image and that no other party's copyright or other ownership of the image is, or is ever likely to be, infringed by its display on this website or by any other use by Volvo Bus Australia. By uploading an image, you agree to indemnify Volvo Bus Australia against any third-party rights infringement claim or other action. If, at any time from the time of upload, you become aware of any such rights infringement, or potential thereof, you agree to contact Volvo Bus Australia via the enquiry form on this website as soon as practicable, specifying which image(s) infringe or may infringe any such rights so that the image(s) can be removed from the competition entries and consequent website display.
3. Entry into this Competition deems your consent for Volvo Buses to use any or all images submitted for unlimited promotional purposes including their 2014 Calendar and ongoing communications.
4. All images submitted into the Competition must not exceed 8MB, with a high resolution version to be available upon request. Only .jpg, .gif or .png images will be accepted. If a low resolution image is selected for ongoing use, you may be contacted for a better quality image.
5. To submit an entry, the Eligible Entrant must use a compatible browser to visit volvobusphotos.com ("Competition Website"). The Eligible Entrant must then follow the directions on the Competition Website. The Eligible Entrant will be required to provide their name, e-mail address, image title, image description, image location and photo category. In order to submit an entry and, in accordance with the directions on the website, the Eligible Entrant must provide all the information listed above.
6. All entrants must ensure that the Promoter receives their entries during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
7. All entries to the Competition may be subject to verification by the Promoter.
8. The Promoter may, at its absolute discretion, declare an entry invalid if the entrant submits an entry that is not in accordance with these conditions or deemed unsuitable for entry.
9. An entry by more than one person (ie a joint entry) is invalid.
10. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the Internet service provider used.
11. Eligible Entrants must make their entries manually using an Internet browser. The Promoter may reject entries if it reasonably forms the opinion that they have been entered using automated entry means, by use of a competition entry service.

Judging

1. There will be four Prize categories: 1st Prize; Runner’s Up Prizes; Photo of the Month Prizes; and People’s Choice Prize.
2. There will be one (1) 1st Prize, eleven (11) Runner’s Up Prizes and five (5) Photo of the Month Prizes that will be decided by a panel of judges consisting of two (2) Volvo Bus Australia representatives and two (2) representatives from Volvo’s Advertising Agency.
3. The ten (10) People’s Choice Prize finalists will be determined by online votes (the ten images with the highest number of votes). The finalists’ entries will be displayed at the 2013 BusVic Maintenance Conference and Bus Expo on Monday July 1 and Tuesday July 2, 2013 and the Winner will be decided by votes from the Expo patrons.

Prizes

1. The Promoter accepts no responsibility for any variation of any aspect of a prize, due to circumstances outside its control.
2. Redemption of the prize is subject to the terms and conditions associated with the prize.
3. Prizes will be sent via registered mail or other courier service to the Prize Winners within 4 weeks of the end of the Competition Period. Volvo Buses will cover all postage costs and will take no responsibility for prizes lost or damaged in transit.
4. Prizes are not exchangeable or redeemable for cash or other goods or services.

Winners

1. The Winners will be notified by e-mail to the e-mail address indicated in their entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
2. The winner’s names will be published on the Competition Website on 10.7.2013.
3. If The Prize is not claimed within 3 weeks of notification, the Prize Winner will forfeit their Prize and a re-draw by The Promoter will take place.

General

1. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
2. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
3. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
4. Participants agree to abide by the decisions of the judges, which are final, on all matters pertaining to The Competition. All of the Promoter’s decisions are final and no correspondence will be entered into.
5. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicize its winners, and may be used to market its products to the Entrant. The personal information of the winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter or by visiting www.volvobuses.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Entrant does not provide accurate personal information, the Promoter may determine that they are not eligible to win the prize.
